Terms & Conditions – Horse Transport Services
By booking transport with Nova Transport, the customer confirms that they have read, understood and accepted the following Terms & Conditions.
1. Bookings & Quotations
All bookings are subject to availability and confirmation by Nova Transport.
Prices quoted are based on the information provided at the time of booking, including collection and delivery locations, number of horses, estimated journey distance and any additional requirements.
The customer must provide accurate information regarding the horse being transported, including any behavioural issues, medical conditions or special requirements that may affect transportation.
Any significant change to the journey or requirements may result in an adjustment to the quoted price.
2. Payment
Payment terms will be confirmed at the time of booking.
Unless otherwise agreed, the full balance must be paid no later than the day of transport.
Any additional charges incurred during the journey, including additional mileage, waiting time, tolls, parking charges or changes to the agreed route, may be added to the final amount payable.
3. Cancellations
We understand that circumstances can change. However, once a booking has been reserved, Nova Transport may have declined other work for that date.
Cancellations made with more than 48 hours’ notice may be cancelled without charge unless otherwise agreed at the time of booking.
Cancellations made within 48 hours of the agreed collection time may be subject to a cancellation charge of up to 50% of the agreed transport price.
Cancellations made within 24 hours, or where our driver has already departed for the collection point, may be charged at the full agreed price.
Nova Transport reserves the right to waive cancellation charges at our discretion in genuine emergencies.
4. Collection & Waiting Time
Customers should ensure that the horse is ready to travel at the agreed collection time.
Reasonable loading time is included within the transport price. Where excessive waiting occurs due to circumstances outside Nova Transport’s control, additional waiting charges may apply.
If a horse cannot be safely loaded within a reasonable period, Nova Transport reserves the right to cancel or abandon the journey where continuing would compromise the welfare of the horse, driver or other persons.
5. Horse Behaviour
The customer must inform Nova Transport before booking of any known behavioural issues, including but not limited to:
Difficulty loading or unloading
Rearing, kicking or biting
Scrambling during transport
Aggression towards people or other horses
Previous transport-related problems
Stallion behaviour
Any requirement for specialist handling
Failure to disclose known behavioural issues may result in the journey being refused or terminated and additional charges may apply.
Nova Transport will always prioritise the welfare and safety of the horse.
6. Fitness to Travel
The owner or person responsible for the horse is responsible for ensuring that the horse is fit to travel.
Nova Transport reserves the right to refuse to transport any horse that appears unfit to travel, injured, seriously unwell or where transportation may compromise the horse’s welfare or breach applicable animal welfare or transport legislation.
Any relevant veterinary or medical information should be disclosed before transportation.
7. Passports & Documentation
The customer is responsible for ensuring that all legally required passports and documentation accompany the horse during transport.
Nova Transport accepts no responsibility for penalties, delays or other consequences arising from missing, inaccurate or invalid documentation supplied by the customer.
8. Veterinary Emergencies
If a horse becomes ill or injured during transportation, Nova Transport will take reasonable steps to contact the owner or nominated emergency contact.
Where urgent veterinary treatment is reasonably considered necessary and the owner cannot be contacted, the customer authorises Nova Transport to seek veterinary assistance in the interests of the horse’s welfare.
Any veterinary, emergency, recovery or associated costs remain the responsibility of the horse’s owner/customer unless caused by Nova Transport’s negligence.
9. Delays
While every effort will be made to arrive at agreed times, collection and delivery times are estimates and cannot be guaranteed.
Nova Transport will not be responsible for reasonable delays caused by circumstances outside our control, including traffic, road closures, accidents, adverse weather, mechanical breakdowns, veterinary emergencies or other unforeseen circumstances.
The welfare of horses in our care will always take priority over meeting an estimated arrival time.
10. Vehicle Breakdown
Our vehicles are maintained with safety and reliability as a priority.
In the unlikely event of a breakdown or vehicle issue, Nova Transport will take reasonable steps to arrange recovery, repair or alternative suitable transport where required.
The safety and welfare of the horse will remain our priority.
11. Insurance & Liability
Nova Transport maintains appropriate insurance for its transport operations.
Customers are strongly advised to maintain their own appropriate insurance for their horse, including cover for transportation where required.
While every reasonable precaution is taken when handling and transporting horses, horses are unpredictable animals and transportation carries inherent risks.
Nova Transport will not be responsible for injury, illness, loss or damage arising from the horse’s own behaviour, an undisclosed condition, inherent risk associated with transporting horses, or circumstances outside our reasonable control.
Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so, including liability arising from Nova Transport’s negligence where such liability cannot legally be excluded.
12. Personal Belongings & Equipment
Any rugs, tack, feed, equipment or other belongings transported with the horse remain at the customer’s risk unless loss or damage results from Nova Transport’s negligence.
Customers should ensure all accompanying items are clearly identified and securely packed.
13. Loading & Unloading
The owner, keeper or responsible person should be available at collection and delivery unless alternative arrangements have been agreed beforehand.
Nova Transport reserves the right to refuse to load or unload a horse where we reasonably believe doing so would create an unacceptable risk to the horse, driver, handler or members of the public.
14. Shared Transport
Where shared transport has been agreed, customers must disclose any relevant health or behavioural information that could affect other horses travelling in the vehicle.
Nova Transport reserves the right to refuse shared transportation where we believe it would present an unacceptable welfare or safety risk.
15. Cleaning & Damage
Customers may be responsible for reasonable additional costs where a horse causes exceptional damage to the vehicle or equipment beyond normal wear and tear, particularly where known behavioural issues were not disclosed before transport.
16. Customer Responsibility
By making a booking, the customer confirms that they are the owner of the horse or have authority from the owner to arrange transportation.
The customer is responsible for providing accurate collection and delivery details, contact numbers and all relevant information concerning the horse.
17. Welfare
Nova Transport operates with the welfare of the horse as our primary consideration.
Our driver may alter, pause or terminate a journey where reasonably necessary to protect the welfare or safety of the horse.
18. Photography & Social Media
Nova Transport may occasionally take photographs of horses or the vehicle during transport for business and social media purposes.
We will respect requests from customers who do not wish their horse to appear on our social media or marketing materials.
19. Complaints
If you are unhappy with any aspect of our service, please contact Nova Transport as soon as possible so that we have an opportunity to investigate and resolve the matter.
20. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
Any dispute arising in connection with these Terms & Conditions will be subject to the jurisdiction of the courts of England and Wales.
